Adjusting opening height

My 2011 x5 35i developed rear hatch closure problem. Opened but would not lower pushing hatch button. Just heard click sound. Agency fixed it by re locking the lower pull out platform. I thought it was in position but I guess not. With the door manually closed it did seem to pull shut to locking position. A BMW X5 door lock lawsuit alleges the doors lock or can fail to unlock spontaneously, leaving people trapped inside the SUVs. The X5 remote door lock class-action lawsuit was filed by California.

In normal operation, pushing the button down will lock the doors and the top of the button will be flush with the top of the door panel. If the ignition is on, pulling the inside door handle or operating the power door lock button will unlock the door and move the lock button back up. A rod connects the actuator to the latch, and another rod connects the latch to the knob that sticks up out of the top of the door. When the actuator moves the latch up, it connects the outside door handle to the opening mechanism. When the latch is down, the outside door handle is disconnected from the mechanism so that it cannot be opened.

You can set how far the tailgate should open.

Adjusting the opening height
When adjusting the opening height, ensure that there is a clearance of at least 4 in/ 10 cm above the tailgate. Otherwise, the ceiling may not be high enough for the open tailgate if the load situation changes.◀

▷ Press the button on the outside of the tailgate when the vehicle is unlocked.
▷ Press the button in the center console.
▷ Press the button on the remote control for approx. 1 second and release.

The opening procedure is interrupted:
▷ When the vehicle starts moving.
▷ By pressing the button in the center console again.
▷ By pressing the button on the remote control for a longer period.
▷ By pressing the button on the outside of the tailgate.
▷ By pressing the button on the inside of the tailgate.

Make sure that the closing path of the tailgate is clear; otherwise, injuries may result.◀

Function requirement:
The lower tailgate is closed and must be locked on both sides.

The tailgate closes automatically when the button on the inside of the tailgate is pressed.

To stop the closing process:
▷ Press the button on the inside of the tailgate.
▷ Press the button on the exterior of the tailgate.

Closing is not canceled when you put the vehicle into motion.

Manually opening or closing

In case of an electrical defect of the automatic tailgate operation function:

1. Manually release the tailgate

2. Open or close the tailgate slowly and without making sudden movements.

It really sucks when you accidentally lock yourself out of your car, especially if you’re stuck somewhere you’d rather not be. Apparently, BMW X5 owners who underwent this ordeal may be able to place the blame on the design of their key fobs, as BMW is currently facing down a class action lawsuit for poor design of the locking function.

Careful Which Button You Press

Apparently, the poor key fob design affects the 2007 through 2013 model year for the BMW X5, with a production date of October 1st, 2006, through June 30th, 2013.

Models that fall in this range that are equipped with the Optional Comfort Access System can experience “Spontaneous or Unintended Locking” according to the lawsuit. Any owners who may have experienced such an event and/or incurred costs because of it could be due some restitution.

The class-action lawsuit comes to our attention from the case Myers v. BMW of North America, currently pending in the United States District Court for the Northern District of California.

This can happen if you press the lock button on the fob, then accidentally place inside the car and close the door, or if you lock the door using the door handle controls with the fob inside the cabin. To make matters worse, once the key fob is locked inside the car, comfort access is disabled, thus making it impossible to unlock the vehicle.

As more and more electronic features are added to cars with every production cycle, screw-ups like this are sure to become more and more commonplace. As for who’s at fault, well… that’s up to the lawyers to decide.
